While McKinley County Sheriff’s Deputy Frank Villa Jr. was on saturation patrol, heading south on U.S. Highway 491 toward Chino Loop, he saw a gray Ford truck fail to stop at a stop sign and turn north onto the highway.

Villa turned his vehicle around and began a pursuit. The suspect vehicle pulled over near the 6 mile marker, where Villa conducted a traffic stop and made contact with the driver, Marland Lee, 32, of Yatahey.

Lee said another truck had been following behind him closely, which is why he did not stop at the sign. Villa noted there was no other vehicle in the vicinity during the incident, and that Lee showed signs of being intoxicated including having bloodshot eyes and the smell of alcoholic beverages coming from inside the vehicle.

After exiting the vehicle, Lee admitted to drinking a beer and some shots earlier in the day. He said he would not be able to blow triple zeros on a portable breath test because he had been drinking the night before. He also refused to take the standard field sobriety tests.

Sergeant Tammy Houghtaling arrived on scene with a portable breath test, with which Lee posted a sample of .12. Lee was placed under arrest for DWI, and Metro Dispatch advised Villa he had three prior DWIs.

Lee was transported to the sheriff’s office for a breath test, where he posted samples of .11 and .12. After a transport to Gallup Indian Medical Center for a medical clearance, Lee was taken to McKinley County Adult Detention Center and booked.

He posted bond on Aug. 20.
