Aggravated DWI (Third)
A man from Round Rock, Arizona, Tyrus Johnson, 43, was turned away at a liquor store and subsequently arrested and charged with his third DWI.
New Mexico State Police Officer Joe Roanhorse was patrolling on Highway 264 when Metro Dispatch advised him of a suspected drunk driver who had departed from Sagebrush Liquors after being denied service and was seen leaving westbound on Highway 264.
Roanhorse traveled westbound on the roadway and spotted a vehicle matching the calling description pulling onto the highway near mile marker 11. He pulled behind the red Ford Mustang and conducted a traffic stop on a side street near mile marker 10.
After meeting the driver, Johnson, Roanhorse observed him reportedly show signs of intoxication including bloodshot eyes, slurred speech, and a smell of alcohol inside the vehicle. Then when he exited the vehicle he swayed as he walked and appeared to have urinated himself. There was also allegedly an empty bottle of TAAKA vodka on the driver side’s floorboard.
Johnson reportedly said he consumed a 12 oz. can of an IPA prior to driving. He also said he had a leg injury that could hamper his movement. Roanhorse conducted alternative testing, after which he determined Johnson was too impaired to drive and placed him under arrest.
Roanhorse drove Johnson to the local New Mexico State Police office for the breath test, where he posted samples of .19 and .18. Johnson was then transported to McKinley County Adult Detention Center and booked for aggravated DWI (third), expired registration, and open container.
Following a failure to appear at his pretrial hearing on June 27, a bench warrant was issued for his arrest the same day. No further updates were available at press time.
