A Gallup man arrested July 16 on an outstanding bench warrant remained jailed July 30 on battery on a peace officer, resisting arrest, and disorderly conduct charges, according to a police report.

Adrian Chavez, 30, was seen walking along West Jefferson Avenue by Gallup Police Department Officer Dan Brown. Brown noted in the report that he recognized Chavez as a person who was wanted on an outstanding bench warrant.

“He told me that he was not going to jail,” Brown recorded in the report.

Brown observed that Chavez had been drinking, and when attempting to put Chavez in handcuffs Chavez became combative and began to spit and kick.

“Chavez said he was going to eat me and then spit on me,” Brown wrote.

Chavez, believed to be homeless, repeatedly uttered that he didn’t want to go to jail. Even though Chavez had on a spit mask applied by Brown, he continued being belligerent and managed to spit in Brown’s face at least once, the police report states. Chavez also kicked Brown, the report states.

Chavez was transported to Gallup Indian Medical Center and later booked into the Gallup-McKinley County Adult Detention Center on a $5,000 bond amount, according to jail records.

A jail administrator said last week that Chavez has a separate case which carries no bond amount.
