Aggravated DWI (Third)

A red Chevrolet pickup truck was parked in the middle of the road with the driver, Harris John Harvey, 45, of Iyanbito, slumped at the wheel, which led to Gallup Police being called to the scene.

Officer Matthew Strandy was dispatched to the site of the truck at the intersection of Second Street and Maloney Avenue. Upon arriving, he approached the truck and found two males asleep inside with a case of Bud Light between them and an open container of Bud Light in the cup holder. The driver, Harvey, was asleep at the wheel with his foot on the brake and while the vehicle was still in “drive.”

After placing the vehicle in park and then turning it off, Strandy woke Harvey up, who appeared confused as he responded to Strandy’s questions. Harvey showed signs of intoxication including a smell of alcohol on his person, and told Strandy he consumed three bottles of screwdriver.

Paramedics arrived to evaluate Harvey and determined he was okay. Strandy asked him to clarify what he had consumed prior to driving and Harvey said he consumed three 8-oz. cans of Bud Light in addition to three 25-oz. screwdrivers.

Harvey agreed to take the Standard Field Sobriety Tests, but he performed poorly on each test. Based on his performance, his admission of drinking then driving, and being asleep at the wheel, Strandy determined Harvey was under the influence and not fit to operate a vehicle. Harvey was placed under arrest and he refused to give a breath sample. Strandy was advised by Metro Dispatch that Harvey had two prior DWI convictions and his license had been revoked.

Strandy transported Harvey to the McKinley County Adult Detention Center for booking, but Harvey was refused entry after he complained of heart issues. Harvey was then transported to Gallup Indian Medical Center for a medical evaluation, where he was eventually cleared with paperwork for admission into the county jail. He was booked for aggravated DWI (third), having an open container in a vehicle, and having a suspended license. His pretrial hearing is set for Aug. 18.
