Aggravated DWI

Murillo, 23, passed out with his vehicle running at the Dead Horse Mustang in Churchrock. McKinley County Sheriff’s Office Deputy Arnold Noriega stated in his report that Murillo “noticed there to be several bottles of beer in the center console of the vehicle,” with one opened. When Noriega asked for Murillo to put the open the door, he put the vehicle in drive. He had to be extracted through the passenger door. His two breath sample read .17.

DWI

Cheromiah, 24, not only escaped injury herself when she crashed into a light pole at Third and Maloney, she avoided injuring anyone else. Gallup Police Department Sgt. Benny Gaona stated in his report that when he approached her, he observed that she was swaying, had bloodshot eyes and smelled of alcohol. The two passengers, her 3-year-old son and husband were uninjured. She blew a .14 and .13 during her two Breath Alcohol Content tests.

2nd DWI

Harper, 43, was arrested for DWI, but according to GPD Officer Steven Peshlakai, she admitted to taking four different types of medications that could impair her driving ability. After all, she ran into a fence and knocked down a pole at West Highway 66 and West Coal Ave. She said that she didn’t recall the accident, and that she had “blacked out.” Results of Harper’s blood test are pending.

Danley Tsosie

Aggravated DWI

MCSO Deputy Noriega caught Tsosie driving on the wrong side of the road on Dani Drive. When Noriega exited his vehicle, he noted in his report that Tsosie had all the signs of being intoxicated – bloodshot, water eyes, reeking of alcohol and bodily sways. He didn’t pass the field sobriety tests and refused to take the two required breath tests, earning him an aggravated DWI.

DWI

GPD Officer Chavo Chischilly had a close call with Mason, who came with feet of hitting his patrol unit, in a drunken rampage. Her boyfriend, who was also intoxicated, said that Mason, 32, locked him out of their house and took off in his car. When she sped back to the house and exited the vehicle, Chischilly, cuffed her and detained her for “careless driving.” From there, she was taken to the hospital for medical clearance where she failed the field sobriety tests. She blew a BAC of .18 and .17.

DWI

Blackhorse, 30, was pulled over for speeding when the officer noticed he smelled of booze. He failed to pass the field sobriety tests and was booked for his first DWI. He blew a .15 – twice.

 

* In New Mexico, it is illegal to drive with a breath or blood alcohol concentration of .08 or more if you’re 21 or over, or .02 if you’re under 21, or .04 if you drive a commercial vehicle. You can be convicted of DWI even if the breath or blood test is below the legal limit if it is proven that your ability to drive was impaired to the slightest degree by drugs or alcohol. – MVD New Mexico
