Aggravated DWI (Third)

A McKinley County Sheriff’s Officer stopped to assist Darold Johnson, 33, of Rehoboth, with vehicle trouble but ended up arresting him for DWI.

Deputy Savannah Benally was driving near mile marker 2 on Hassler Valley Road when she saw a blue Nissan passenger car parked in the westbound lane. Benally pulled behind the vehicle and stopped, suspecting the vehicle was having mechanical problems.

Benally met the driver, Johnson, who said he was trying to push his vehicle off the road to the side. Johnson reportedly showed signs of intoxication including slurred speech and smelling of alcohol. His answers to Benally’s questions were also incoherent and vague.

Johnson agreed to take the Standard Field Sobriety Tests. During the tests, however, Johnson began to argue with officers at the scene and eventually became combative. He tried to pull away from officers as they attempted to place him in handcuffs.

After restraining Johnson, Benally checked inside his vehicle. The search revealed an open container of Mike’s Hard Lemonade in the backseat. The computer aided dispatch also informed Benally that Johnson had prior DWI convictions.

Johnson remained combative and refused to give a breath sample. He was later booked into McKinley County Adult Detention Center for aggravated DWI (third), open container, driving with a revoked license, stopping on highway, and resisting arrest. His pretrial hearing is set for Feb. 20.
