Jaqueline Jean Smith

Aggravated DWI

Gallup Police Officer Iris Pinero was dispatched to the area of the 200 block of East Coal Avenue in connection with a driver passed out behind the wheel.

When she got to the scene, she said she found a car with heavy front end damage, Jaqueline Smith was behind the wheel passed out. It took several attempts to wake her up.

When Smith, 46, of Ganado, exited the vehicle, Pinero said she staggered to keep her balance. She was asked about the damage to the car and replied, “What damage.”

She denied she had been in an accident and although police searched the area to try and find an accident site, none was found.

She was asked where she was coming from she said Iyanbito and said she was going home to Ganado, she admitted to having had three or four cans of beer before driving.

Smith declined to take the standard field sobriety test, saying she already failed. She also refused to take a breath alcohol test. Smith was also charged with having an open container in a motor vehicle, mandatory financial responsibility, display of current valid registration plate, and driver’s license required.

She was released on her own recognizance by a judge.

Elon Cooley

DWI - Drugs

Elon Cooley came to the attention of Gallup police when he reportedly failed to yield and drove onto the highway in front of a police car, almost hitting it.

Gallup Police Officer Warren Bowannie was dispatched to take the report. He said Cooley, 18, of Gallup, admitted he had no driver’s license. Bowannie said he saw flakes of a green leafy substance on his lap and noticed he had red, bloodshot eyes.

Cooley admitted he had been taking marijuana that night but didn’t know how much. He told Bowannie it was medical marijuana.

He agreed to take the standard field sobriety test which he failed. He was arrested for DWI.

Bowannie asked him to consent to have blood drawn for a blood test which he agreed to do. After the blood was drawn, he was taken to the county jail and booked.

He was released on his own recognizance by a judge.

Calvin Harvey

Aggravated DWI

Gallup Police Officer Timothy Hughte was on regular patrol along East Highway 66 when he noticed a car merge onto the highway with no headlights or taillights on and conducted a traffic stop.

He then talked to the driver, Calvin Harvey, 52, of Gallup, who he said showed signs of being intoxicated. He also had a lost look on his face as he talked.

Harvey admitted to Hughte he had had two beers before driving and agreed to take the standard field sobriety tests, which he failed.

Harvey was arrested for DWI and later agreed to take a breath alcohol test during which he posted samples of .20 and .19.

He was released on his own recognizance by a judge.

Oneius Dean

Aggravated DWI

Gallup Police Officer Aaron Baldonado said he was dispatched to a two-vehicle accident on the 2000 block of West Highway 66.

When he got there, he found two cars with heavy damage. He was told by one of the officers at the scene that one if the drivers, Oneius Dean, 22, of Navajo, N.M, may be intoxicated. Baldonado said when he went to interview Dean, he saw indications that he may be intoxicated.

Dean admitted to having had two shots before driving, but added he was not sure exactly when he had the shots.

Despite the fact he almost fell over when he exited his car, he agreed to take the standard field sobriety tests and failed. He agreed to take a breath alcohol test and when he was taken to the police station and told to sit, he missed the seat and had to be helped up.

He finally took the test and posted two samples of .23. He was also charged with driver’s license required, mandatory financial responsibility, having an open container in a motor vehicle, and following too closely.

Dean was released on his own recognizance by a judge.

Lisa Clark

Aggravated DWI

Gallup Police Officer Victor Madrid was dispatched to investigate a car that went into the ditch behind the KC Hall.

When he got there, he met Lisa Clark, 44, of Gallup, who said she was reaching back in her car for her bag when she went into the ditch. Madrid said he could smell the odor of intoxicating liquor coming from the vehicle and asked her if she had been drinking.

She admitted she had five beers before driving. When asked if she was willing to take the standard field sobriety tests, she agreed and failed and was arrested for DWI.

Madrid said he then asked her twice if she would take a breath alcohol test and she just remained silent which he took as a refusal. She was also charged with driving without a license.

She was released on her own recognizance by a judge.
